Tennis Pass
TENNIS PASS TERMS AND CONDITIONS
These Terms and Conditions form the Agreement between you and us, Teignbridge District Council for an Annual Tennis Pass.
- Definitions
In these terms and conditions, the following word have the following meanings.
Annual Tennis Pass: runs for one year from the date you pay for it (unless terminated in accordance with these terms and conditions). Concessions and Concessionary Rates apply.
ClubSpark Portal: the portal which the Council will utilise for advance bookings or such other portal as the Council notify the Household from time to time is to be used for bookings.
Concessions/Concessionary Rates: means if you are receiving an annual pass concession, you will need to validate this annually by providing evidence of current continued entitlement as follows.
Eligibility for concessionary rate – that you are in receipt of the following benefits: Children in care (evidence letter from social worker), Council Tax Support, Disability living allowance, Foster carers (evidence: Devon County Council ID badge), Housing benefit, Income related employment and support allowance, Income based job seekers allowance, Pension credit, Personal Independence Payment, Universal Credit (take home pay less than £435.00 per month), or that you are a Full time Students 16 years old plus – evidence of official confirmation of full time education (NUS card does not apply) (Household status does not apply).
Council: means Teignbridge District Council.
Household : means to 10 people who live at the same address.
Maximum Playing Time: means in each rolling period of 10 days the ability to book either 6 x 1 hour booking slots or 3 x 2 hour booking slots.
Park Courts: means the tennis courts owned by the Council located at Bakers Park, Totnes Road, Newton Abbot, TQ12 1LP, Ford Park Tennis Courts, Forde Park Road, Newton Abbot, TQ12 1AW, Buckfastleigh Tennis Courts, Ducksponds Road, Buckfastleigh, TQ11 0NL.
2. Annual Tennis Pass
2.1. The Annual Tennis Pass can be used by a Household to book the Park Courts for the Maximum Playing Time, at no extra cost.
2.2. All bookings must be made via the ClubSpark Portal online system up to 10 days in advance. The Park Courts Booking Terms and Conditions apply
2.3. Please ensure that you only book the Park Courts that you intend to use and cancel those that you cannot use, even if it is last minute to allow others the opportunity to book.
3. Terms
3.1. The Annual Tennis Pass does not allow you to charge people to use your booking.
3.2. The Annual Tennis Pass will not be fully, or part refunded for any reason.
3.3. Delivery or receipt of coaching services on the Park Courts is not permitted under the Annual Tennis Pass.
3.4. Delivery or receipt of a non-tennis activity is not permitted under the Annual Tennis Pass.
3.5. There will be no refunds for the Annual Tennis Pass if the Park Courts have to close for any reason.
3.6. All players are required to register online or via the ClubSpark Portal system and book a court before playing.
3.7. Parents and guardians take full responsibility for the welfare & security of their children who are aged 16 and under, when they are on the Park Courts.
3.8. Players aged 12 and under must be supervised at all times by a parent or guardian when at the park Courts.
3.9. Closures of the Park Courts for any type of court works or due to damage will not result in refunds or pass extensions.
3.10. The Annual Tennis Pass is not transferable outside of your Household.
3.11. No-one in your Household may share the gate code to the Park Courts with a third party outside the Household.
3.12. Any players found trying to access or using Park Courts when they are closed will have their passes and bookings cancelled without refund for the Park Courts.
3.13. If you breach any of our guidance’s or terms the Council reserves the right to cancel all passes and bookings without refund.
3.16. All players are required to read the Park Courts Booking Terms and Conditions.
4. Coaching & General Hire Terms
4.1. Delivery or receipt of coaching services is not permitted under the Annual Tennis Pass.
4.2. Delivery or receipt of a non-tennis activity is not permitted under the Annual Tennis Pass.
4.3 Coaches running hitting or practice match sessions for free or for a charge is a form of coaching and not permitted under the Annual Tennis Pass.
4.4. The Annual Tennis Pass not permitted to be used for the delivery or receipt of coaching services, this includes teaching your own or anyone else's children, any friends or your or their family members, etc. Your Annual Tennis Pass will be cancelled without refund if delivery or receipt of coaching services is found to be taking place without Council permission.
5. Important to note
5.1. Should the terms & conditions as set out above or any others set out on the Council’s Tennis website or agreements be breached, the Council reserves the right to withdraw the Annual Tennis Pass from all players without refund.
5.2. The Council reserves the right to pre-book the courts for coaching, events, and maintenance and to allow targeted free access at specified times.
5.3. The Council reserves the right to close the Park Courts for any reason.
5.4. By booking and using or playing with someone under their booking, on any of the Park Courts, you are accepting the Council’s terms and safe to play guidance.
5.5. The Park Courts are for recreational tennis play only unless you have an in date coaching package or general hire pass.
5.6 The Council reserve the right to remove and withdraw passes at any point and will endeavour to communicate with You at the earliest opportunity providing details of options that are available to You.
5.7 The Council can suspend or cancel your Annual Tennis Pass immediately if you provide details you know to be false when applying for the Annual Tennis Pass and those details reasonably affected our decision to grant the Annual Tennis Pass.
- General
6.1 Facilities may be withdrawn from time to time for repairs, refurbishment, tournaments, special events or closure. Wherever possible, 2 weeks’ notice of any disruption to the regular programme will be advertised.
6.2 Where full or part closure of facilities and programmes is required due to government or local authority restrictions The Council will endeavour to communicate with the Household earliest opportunity providing details of options that are available.
6.3 Generally, a facility will be open diary during daylight hours (weather permitting) as the courts are not lit. It is the responsibility of the booker to check daylight hours and the weather forecast.
6.4 Sessions and facilities are subject to change without prior notification and may also be subject to cancellation should the session or facility be deemed no longer viable.
