Terms of Use
1. By booking and using the Elmbridge Park Tennis courts you are accepting all of the terms and conditions, please make sure you have read an understood them along with the Safe to Play Guidance.
- 1.1. If you breach any of our guidance’s or terms the Council reserves the right to cancel all memberships, packages & bookings without refund.

2. Play Tennis Pass terms overview
- 2.1 The Play Tennis Pass is charged at £36 per year, to use any of our 12 Park Tennis sites (one booking per day, max 2 hours).
- 2.1.a. The Play Tennis Pass will increase to £40 per year from the 1st April 2023.
- 2.2. All members are required to register through the ClubSpark system and book a court before playing.
- 2.3. Membership runs for one year from the date you activate your online account and pay.
- 2.4. This pass does not allow you to charge people to use your booking.
- 2.5. This pass is not for the delivery or receipt of tennis coaching or non-tennis activities.
- 2.6. If unauthorized coaching or non-tennis play activity is found to be taking place all users will have their passes cancelled without refund.
- 2.8. Membership will not be full, or part refunded.

3. Play and Play terms overview
- 3.1. Pay and Play is charged at £5 per hour, per court to use any of our 12 Park Tennis sites (max 2 hours per day).
- 3.1.a. The Pay and Play charge will increase to £5.50 per hour, per court from the 1st April 2023.
- 3.2. Players must register through the ClubSpark system to book and pay the court fee before playing.
- 3.3. Pay and Play does not allow you to charge people to use your booking.
- 3.4. Pay and Play is not for the delivery or receipt of tennis coaching or non-tennis activities.
- 3.5. If unauthorized coaching or non-tennis play activity is found to be taking place all users will have their passes/bookings cancelled without refund.
- 3.6. The refund window for cancelling courts ends 1 hour before your start time.
- 3.7. Refunds can take up to 5 - 10 working days to show in your account from stripe.

4. Court Bookings terms overview
- 4.1. You must book a court online before you play, 7 days advanced booking.
- 4.2. Please ensure you cancel any unwanted bookings, even if it is last minute.
- 4.3. You can make one booking per day for anywhere from 30 minutes to 2 hours.
- 4.4. If you are late to your booking, this does not alter your end time unless you have altered it online.
- 4.5. The Council reserves the right to pre-book the courts for coaching, events, targeted free sessions, and maintenance.
- 4.6. The Council has the right to cancel bookings at their discretion. An email will be sent to the court booker to notify them.
- 4.7. Some recreation grounds close at night, it is the bookers responsibility to check for any closing times, prior to booking.

5. Court Rules overview
- 5.1. Smoking is not allowed on the courts.
- 5.2. Dogs are not allowed on the courts at any time, keep them off court.
- 5.3. Players must wear appropriate sports clothing and clean footwear when on court.
- 5.4. Ensure you close the gate properly when you leave.
- 5.5. Take off the court everything you take on (please use bins provided for litter)
- 5.6. Players and coaches should comply with the principles of respect and fair play, both on and off the courts.

- 5.8. Our outdoor Park Tennis courts playability is subject to weather conditions.
- 5.9. Players use the courts at their own risk and are asked to apply common sense in looking out for themselves and others at all times.
- 5.10. Any form of coaching for free or for a charge is not permitted under the Play Tennis Pass or Pay & Play.
- 5.11. Coaches running hitting sessions for players for free or for a charge is also not permitted under the Play Tennis Pass or Pay & Play.
- 5.12. Only authorised coaches or providers who hold a valid in date Coaching Pass/Package or General Hire Pass can coach on the courts or run a non-tennis activity.
- 5.13. Do not climb the fences, or make holes in the fence/gates to put anything into the gate locks or use anything to block the gate open.

6. Right to Play
- 6.1. You must book a Court online before playing
- 6.2. If someone is playing on the Court when you arrive use your booking confirmation as proof.
- 6.3. If you have any problems, contact us on 01372 474 474 during office hours (Mon-Fri 9am-5pm).
- 6.4. Your right to play is from the start time and end time listed in your court booking, it is not when the PIN codes are active.
7. Other court usages
- 7.1. To use the courts for any other reason apart from tennis play or authorised coaching, you will need to apply for and hold an in date valid General Hire Pass.
- 7.2. If you do not have a General Hire Pass and are using the Coaching Pass/Package, Play Tennis Pass or Play & Play option for other activities you will have all your passes and bookings cancelled without refund.

8. Coaching
- 8.1 Coaches must hold an in date valid coaching package not a Play Tennis Pass or use Pay & Play.
- 8.2. The Play Tennis Pass and Pay & Play option are not for any form of coaching (free or for a charge), they are for playing tennis only.
- 8.3. Coaches running lessons, hitting or practice match sessions for free or for a charge is a form of coaching (the intention is to teach not just play tennis) and is not permitted under the Play Tennis Pass or Pay & Play.
- 8.4. Authorised tennis coaching providers will be listed on the specific venue pages, if you are not listed you do not have a coaching pass or package & are not authorised to coach on the park sites.
- 8.5. Coaches who coach under the Play Tennis Pass or Pay & Play option or breach any coaching pass/package terms & conditions will be reported to the LTA and have all passes and bookings cancelled without refund. Client/s bookings and pass will also be cancelled without refund.

9. Court Closures
- 9.1. There will be no refunds for the Play Tennis Pass if the courts have to close for any reason.
- 9.2. If you purchase a Play Tennis Pass during lockdowns/closures your pass will not be refunded or extended.
- 9.3. Closures of any court/venue for any type of court works or due to damage will not result in refunds or pass extensions.
- 9.4. If the Government and/or the LTA call for the closure of all tennis courts for 2 week or less, there will be no extension or refunds of the Play Tennis Passes.
- 9.5. If the Government and/or the LTA call for the closure of all tennis courts for 3 weeks for or more, we will extend all Play Tennis Passes which were brought prior to the court closures by the same number of weeks.
- 9.6. Pay and Play bookings must always cancel their own bookings before the refund window closes, which is an hour before your start time (refunds can take 5 to 10 working days to show in your account).
- 9.7. ETC Sports have advised, courts that have been recently resurfaced will have a 24 month period after completion where if the weather conditions are very hot, the courts may have to close to protect the new surface.
- 9.8. Following reviews on the maintenance costs of the touchtennis courts and overall usage levels, Elmbridge Borough Council have made the decision to close the touchtennis courts. This means they will not be set up or open for touchtennis play in 2023 or onwards.
10. Weather
- 10.1. Our outdoor Park Tennis courts playability is subject to weather conditions, please take a common sense approach and be sensible, if in doubt please cancel your booking & book another day.
- 10.2. Do not use the courts if there is a red or amber weather warning in place, re-book for another day as there is a possibility of significant disruption and dangerous conditions.
- 10.3. We recommend not using the courts if there is a yellow weather warning in place, re-book for another day as there is a possibility of disruption.
- 10.4. Players use the courts at their own risk and are asked to apply common sense in looking out for themselves and others at all times.
